The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. The judgement can be seen here A Reference by the Attorney General for Northern Ireland of a devolution issue under paragraph 34 o….

We would encourage you to familiarise yourselves with the judgment and carefully consider the implications for your services and practice. Please see the following links for further information: CQC statement on the Supreme Court's judgment on deprivation of liberty - Care Quality Commission and 2026-UKSC-16-Summary-for-website.pdf.

We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

We hope this offers reassurance whilst we wait for additional National guidance to be disseminated.  At this stage we don’t have further information, but if you have a specific query, you can contact the MCA DoLS Duty Team at Dolforms@essex.gov.uk

Essex County Council - Provider Hub
Text size:

Our commissioning intentions describes how Essex County Council intend to shape the local services to meet the needs of our residents for the next few years.

We have recognised that good commissioning is that person-centred and focuses on strength-based outcomes, and that it empowers people of Essex to have choice and control in their lives and over their care and support needs. To achieve this, we shift towards strategic commissioning, meaning we work more closely with our key partners across the system (care market and health) to understand population needs, determine key priorities, design, and plan service resources to meet those needs.

The strategic commissioning intentions are in line with our Adult Social Care Market Shaping Strategy 2023-30 and ASC Business Plan, making a difference every day!

We have developed the market principles that will be utilised as part of our existing service delivery and support our future commissioning of services across Essex.

Person-centred & Inclusive

We have a ‘can do’ approach which focuses on what matters to people and we think and act creatively to make things happen for them.

Community-based

We work in partnership with others to make our local area welcoming, supportive and inclusive for everyone

Transparency

We make sure we share information about what we do and how people can access our service with other relevant organisations so we can all work more effectively.

Wellbeing & Independence

We make sure people feel safe and comfortable in their own home, which is accessible, with appropriate aids, adaptations, technology and medical equipment.

Evidenced based & Service Quality

We don’t make assumptions about what people can or cannot do and don’t limit or restrict people’s options

Collaboration & Integration

We work with people as equal partners and combine our respective knowledge and experience to support joint decision-making.

In line with our market strategy, we have developed a 7-year roadmap of our future direction and the ambition for adults of Essex.
