The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

Description:

Develop and deliver recommissioning workstreams for replacement of current contractual arrangements.​​

Key Milestones:

  • Review and simplification of operational practice for referral to day ops
  • Market engagement and provider development
  • Review current provision
  • Design commissioning and commercial approach for replacement of contracts, including securing appropriate resources

 

3 Year Delivery Plan by end of 2027

Description:

New contracts in place replacing current provision (LIVE) due to expire in 2025

Key Milestones:

  • New contracts in place. Support available for:
  • Respite for carers
  • Reasonable adjustment to access existing community provision
  • Building based sites where needed to meet need
  • Technology utilised to support with meeting needs
  • Placement processes refined and outcomes monitored

 

7 Year Delivery Plan by end of 2030

Capacity and demand management

  • Accessing available support already in communities via reasonable adjustment

Delivering good quality services

  • To utilise providers that have good or outstanding CQC ratings across Essex
  • To support providers with poor quality to exit the market if there is oversupply within the area or support providers where a need or supply is necessary
