The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

The council commissions its longer term domiciliary care and support services through the Live at Home (LAH) 2021 framework. The LAH framework commenced on the 12th August 2021 and expired on the 8th November 2025.

Packages commissioned under the 2021 framework with providers that joined the 2025 framework have been superseded and replaced by the 2025 framework terms and conditions as per Schedule 15 (Transition) of the framework agreement.

Packages commissioned under the 2021 framework with providers that didn't join the 2025 framework remain under the 2021 framework terms and conditions.

Essex County Council is currently not actively seeking applications from new providers to join our domiciliary spot market.

Providers are welcome to express an interest in becoming a spot provider. ECC will be in touch should a need for a new service provider arise. Please note, receipt of an expression of interest or application is not a guarantee of work with the Council.

ECC's current position is not to work with providers until they have been rated by the CQC. If you are unrated, you are welcome to express an interest however ECC will not consider your organisation until you have been rated.
