The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

Children Placed less than 20 Miles away from their home address

As of the 31st March 2023, 998 Children or young people (Excluding SMC) in care were placed within Essex.

The map provides the rate per 1000 of 0-17 year olds in care across Essex based on their home district.

It is noted that the rate of children or young people in care within Harlow and Tendring are higher than the majority of Essex. This is comparable to high levels of deprivation and low income.

 

 

e.g. 5.6 children per 1000 children are placed in Tendring where Tendring is their home district.

 

Children Placed more than 20 Miles away from their home address

The map above shows the proportion of Children and Young People (excluding SMC) placed into care more than 20 miles away from their home address.

70% of Children or Young People residing in Uttlesford who come into care are placed outside of a 20 mile radius. This is higher than other districts, but Uttlesford has one of the lowest volumes of Children in care.

Basildon, Tendring and Colchester have the highest volumes of children in Care. Between 17 – 25% of Children or young people from these districts are placed more than 20 miles from their home address.

Harlow has the 4th largest volume of Children  in Care, with 46% placed more than 20 miles from their home address. This may indicate a lack of placements in Harlow and neighbouring districts.
