The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. We would encourage you to familiarise yourselves with the judgment and carefully consider the implications for your services and practice. We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

Reviews will take place as usual but in addition, Social Workers will be referring to a checklist for ageing well when undertaking reviews, with anyone who is seen to be showing signs of ageing. Click on this link to see the checklist

This checklist helps to remind the Social Worker, the person whose review it, Families and Carers and Service Providers of all the things that should be in place to support a person to age well.   

Prompted by the check list, the Social Worker will be asking to see a range of documents that are suggested to be in place, to check that they are up to date and relevant for the person with a learning disability and in a format that they are most likely to understand.

Remember too that we as Family Carers can have an important role to play in quality assurance, as we are likely to be able to visit our loved much more frequently than a Social Worker so we can use the checklist to make sure that we are happy that everything necessary is in place and of good quality’.  - Essex Carers Network 

In addition, as family carers, we are very likely to be approached to contribute to putting some of these documents together, such as a Life Story Books and memory boxes.
