The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. The judgement can be seen here A Reference by the Attorney General for Northern Ireland of a devolution issue under paragraph 34 o….

We would encourage you to familiarise yourselves with the judgment and carefully consider the implications for your services and practice. Please see the following links for further information: CQC statement on the Supreme Court's judgment on deprivation of liberty - Care Quality Commission and 2026-UKSC-16-Summary-for-website.pdf.

We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

We hope this offers reassurance whilst we wait for additional National guidance to be disseminated.  At this stage we don’t have further information, but if you have a specific query, you can contact the MCA DoLS Duty Team at Dolforms@essex.gov.uk

Adult Social Care known Carbon Footprint and Emissions

Adult Social Care has one of the highest emissions across within Essex, this is due to the nature of the service and variance of professional support and services offered within the community, or within a residential setting. Some of the key early indicators or reasons are:

  • Carer Workforce: There is approximately 33,000 social care carers across our domiciliary and residential care services which is due to increase by another 11,000 by 2030.
  • Travel and Transport: Essex has a both a wide mixture of an rural and urban demography, so when travelling to adults traffic, parking, distance between visits can play a huge factor in social care activity and ultimately our carbon footprint.
  • Use of Equipment or Products: All our carers will use specific equipment to support adults within the community or in a residential setting. This includes PPE for carer, professional or family members. Use of cars, mobile devices, laptops, PC's, stationary, physical equipment and aids to help the adult, as well as medication or medical equipment or packaging.
  • Buildings and Land: Residential settings can often be older buildings, that require to be warmer for adults residing in the building.
  • Energy and Waste: The use of energy such as fossil fuel gas, electric and the need to use green energies moving forward. This also include the reduction in the use of water and water waste.
