The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

Occupational Therapy services

Specialist Occupational Therapy (OT) service supporting people with a disability and/or Autism and their Carers are available within ECC. The Occupational Therapist can offer a holistic assessment and intervention, assessing occupational performance in activities of daily living, sensory integration, and behavioural needs. They can also look at the environment from a physical dysfunction, sensory processing, and behaviour management perspective, recommending adaptations to ensure the environment supports the person’s activities. 

An OT may also be able to work with support staff and unpaid carers to support them in caring for the adults. This may involve making recommendations regarding moving and handling techniques and/or equipment, delivering person-specific sensory awareness training, covering strategies to support the individual and interventions to reduce the risk of carer or placement breakdowns. 

OTs can assess a person’s performance in their activities of daily living, which can help capture the baseline level of functioning of the person. This can help inform an understanding of how the ageing process is affecting the person over time. The OT may offer advice and guidance on how to engage someone in meaningful activities in a person-centred way as the adult ages. This is a time when interests and abilities may be changing and they may begin to decline previously enjoyed activities. 

Disabled Facilities Grant - OTs can assess if a person needs help and are eligible for help with home adaptions if they are disabled or have a long-term health condition. They will need an occupational therapy (OT) assessment to see if these changes will help them manage everyday tasks at home. They may be eligible for support for minor adaptations or eligible for a Disabled Facilities Grant if they’re disabled or have a long-term health condition and need to make changes to their home environment.
