The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. The judgement can be seen here A Reference by the Attorney General for Northern Ireland of a devolution issue under paragraph 34 o….

We would encourage you to familiarise yourselves with the judgment and carefully consider the implications for your services and practice. Please see the following links for further information: CQC statement on the Supreme Court's judgment on deprivation of liberty - Care Quality Commission and 2026-UKSC-16-Summary-for-website.pdf.

We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

We hope this offers reassurance whilst we wait for additional National guidance to be disseminated.  At this stage we don’t have further information, but if you have a specific query, you can contact the MCA DoLS Duty Team at Dolforms@essex.gov.uk

The conferences are an opportunity for Nurses to keep up to date with their skills and knowledge which contributes towards evidence for their revalidation.

Past conferences have included:

A range of clinical training sessions, such as:

PEG feeding

Male/Female Catheterisation

Tracheostomy Care

Syringe Pump Practical

Pressure Ulcer new guidance

Environmental Cleaning

Wound Care

Care Planning

A networking lunch provides nurses an opportunity to visit the conference display stands and to meet representatives from across the sector. Past conferences have included stands from the National Midwifery CouncilRoyal College of Nursing and Skills for Care.

Our Nursing CPD Conferences usually take place in November, current dates can be found in our Current Programme of Training

All of the conferences provide Certificates detailing the number of CPD Participatory hours and conference agenda.

The Royal College of Nursing (RCN) detail that a component of the CPD for revalidation must include 20 hours of participatory learning: "Participatory learning is a learning activity undertaken with one or more professionals where you personally interact with other people. The learning activity does not always need to be in a shared physical environment, it could be in a virtual environment, such as an online discussion group or a professional Twitter discussion. The professionals you engage with through participatory learning do not have to be health care professionals."
