The Supreme Court's judgment on deprivation of liberty

You may be aware that the Supreme Court has recently issued a judgment which significantly changes the legal approach to determining whether a person is deprived of their liberty. We ask that you refer to this updated position when making any new referrals to the DoLS team.  In addition, as the change came into effect immediately from 2 June, please review any recent DoLS referrals you have made. You should consider whether, in light of this revised approach, any of these referrals may no longer be appropriate.

Private Funders/Funds Drop Information (1)

Essex County Council (ECC) has recently received enquiries from people in residential or nursing care who are either close to the capital threshold of £23,500 or have already fallen below it after arranging their own private care placement. These individuals are now seeking Local Authority (LA) funding to continue their placement.

Many people are unaware of the correct process for moving from a self-funded arrangement to Local Authority support. Care providers are therefore encouraged to give timely and accurate information so that individuals can make suitable choices, remain in control of their care arrangements, and avoid potential issues or distress later on.

We want to make sure providers share the right information at the right time so that choices are sustainable and the person stays in control as much as possible to avoid possible challenge and distress later to adults and/or their representatives.
